In a significant legal move, Apple has initiated a lawsuit against OpenAI, filing the case in a US federal court. The tech giant accuses the artificial intelligence company of improperly acquiring Apple’s sensitive trade secrets, specifically in areas concerning hardware development, manufacturing processes, and the intricacies of its supply chain operations.
The complaint from Apple details allegations that former employees, who transitioned to OpenAI, retained and disseminated proprietary information. This, Apple contends, has granted OpenAI an undue competitive edge as it reportedly ventures into developing consumer AI hardware products. The allegations extend to claims of former employees accessing protected information, engaging with Apple suppliers, and seeking confidential insights during recruitment processes.
Central to the lawsuit are accusations involving several ex-Apple executives and engineers. Notably, Chang Liu is mentioned for allegedly not returning an Apple-issued laptop upon his departure. Furthermore, Apple points to Tang Yew Tan, a former senior executive who assumed the role of Chief Hardware Officer at OpenAI. Apple claims Tan engaged in discussions with OpenAI affiliates and Apple suppliers before his exit, suggesting a breach of trust and confidentiality.
Apple asserts that OpenAI and its associated entities have systematically targeted Apple’s secretive technology and expertise in manufacturing, along with its product development methodologies and strategic supply chain partnerships. This alleged conduct is seen as an attempt to fast-track OpenAI’s entrance into the consumer AI hardware sector. The lawsuit underscores Apple’s assertion that over 400 of its former employees have found positions within OpenAI, adding gravity to its claims of systematic targeting.
In response to what it perceives as deliberate and harmful misappropriation of its confidential business information, Apple seeks both preliminary and permanent injunctions from the court. These would aim to halt the alleged misuse of its trade secrets. Additionally, the company is pursuing financial compensation for the reported damages. As of now, OpenAI has not issued any public comments regarding these allegations.
